Terms and Conditions

The domain and this website (the “Site”) belong to Moticristo, Comércio de Automóveis, S.A., with registered office at Rua Almirante Gago Coutinho, no. 4, 2640-487 Mafra, Portugal, corporate taxpayer no. 502641436, which is responsible for its operation and management. Use of the Site implies full acceptance of these Terms and Conditions (“T&C”) by its users.

Site Terms of Use

Access to the Site

Moticristo, as the owner of the Site, may at any time block access to it by third parties, in particular for repair or maintenance purposes. Moticristo further reserves the right to close the Site whenever any circumstance arises that, in its view, justifies doing so.

Intellectual Property Rights

Moticristo holds the copyright over all texts, drawings, images, graphics and other content made available on the Site. Users are not authorised to reproduce, copy, alter, sell or use these elements without first obtaining the necessary authorisation from Moticristo in writing.

Privacy and Processing of Personal Data

To create an account on the Site, the user is asked for an email address and an access password. It is the user's responsibility to keep these details in a safe place and to change them if there are signs of misuse of the account by unauthorised third parties. Should the personal data provided change, it is the user's responsibility to update it.

User privacy is a central concern for Moticristo. The general principles applicable to the collection and processing of personal data are set out in our Privacy Policy, complemented by the Cookie Policy.

Changes to the Terms and Conditions

Moticristo reserves the right to make any changes that prove necessary to these T&C. Whenever this happens, the changes are published on the Site, so users are advised to consult them regularly.

Online Store Sales Conditions

The purchase of products through Moticristo's online store is subject to Portuguese law and governed by the following conditions.

Purchase

Products are presented in the store with a description that allows the buyer to know their essential characteristics and price. The buyer selects the products they wish to purchase, confirms their choice and declares that they know and accept these conditions through a validation click.

At that point, the order amount is charged, except where payment is made in advance (in particular by Multibanco reference, MB WAY or another means). Moticristo undertakes to confirm and inform of the availability of the ordered products within a maximum of 48 hours from receipt of the order.

Once the order is validated or cancelled, a communication is sent to the buyer (email, SMS or other) informing of the dispatch or cancellation. In the event of full or partial confirmation of the order, Moticristo makes a definitive commitment to dispatch the products within the stated period.

Products are deemed received on the date on which the buyer, or a third party indicated by them other than the carrier, takes physical possession of them. Where several goods ordered in a single order are delivered separately, the relevant date is that of receipt of the last item.

Price and Payment

The purchase price of the product is set by Moticristo. For shipments within the European Union, the price shown on the product sheet includes all taxes, duties and shipping costs. For shipments outside the European Union, orders may be subject to import taxes and duties applied at the destination, for which the customer is responsible; prior contact with the local customs authority is recommended to obtain a cost estimate.

All orders are charged in euros. Payment may be made by the means available at the time of payment, in particular Multibanco and MB WAY.

Right of Withdrawal

Under the legislation in force, the buyer has a period of 14 (fourteen) days from receipt of the ordered products to exercise their right of withdrawal with Moticristo, without paying any penalty and without needing to give a reason.

If the right of withdrawal is exercised within the stated period, the price of the purchased products and the shipping costs are refunded. The return costs are borne by the buyer. The products must be returned in their original and complete condition, packaged in the same way as for shipment, within 14 (fourteen) days from the date of the withdrawal communication, to Moticristo's registered office. It is the buyer's responsibility to provide proof of the timely return of the products.

The refund of all payments made, including delivery costs, with the exception of supplementary costs arising from the choice of a delivery method other than the least expensive standard delivery offered by Moticristo, is made within 14 days from the date on which the buyer communicates their decision to withdraw from the contract. Moticristo may withhold the refund until it receives the products back, except where it offers to collect them.

The refund is made using the same payment method used in the initial transaction, unless expressly agreed otherwise, with the buyer bearing no charge arising from the refund. The right of withdrawal cannot be exercised in respect of any product whose warranty and tamper-proof seal has been removed or that has been tampered with. The buyer may be held liable for any depreciation of the item if the handling carried out exceeds what is usually permitted in a retail establishment.

Non-Compliant or Damaged Product

The non-compliant or damaged product must be returned to Moticristo. Moticristo will send, if available in stock, a product of equivalent characteristics and price. If this is not possible, the order amount is refunded to the buyer.

Incorrectly Identified Product

If the error is Moticristo's responsibility, the procedure is the same as for a non-compliant product: the product must be returned and, if a product of equivalent characteristics and price is available in stock, it is sent to the buyer. In the case of products that share the same reference and are nonetheless not compatible, Moticristo is not responsible for that incompatibility, and the buyer should always check whether the product they are purchasing is suitable for their vehicle.

Warranty

Moticristo offers a warranty on all its products, provided that the parts are fitted in workshops regulated by law. Should faults or errors occur during the warranty period, the customer must notify Moticristo, in particular by email or by any other means capable of providing proof, and deliver the goods covered by the warranty, without undue delay, so that they can be assessed, repaired and, where applicable, returned.

In the first 12 months, if the product shows defects, these are presumed to have already existed at the date of the sale. In the remaining 6 months, if the product shows defects, it is for the customer to prove that they already existed at the date of purchase. The following are excluded from the warranty:

  • Consumables and wear parts;
  • Damage caused by transport not reported within 24 hours of receipt of the parts;
  • Paint damage or defects, since the parts are used and may show signs of wear;
  • Electrical material once fitted.

A/C Compressors

For this type of part, no warranty is accepted unless the following steps are taken:

  • Replacement of the filter;
  • Cleaning of the circuit, with suitable equipment and fluids;
  • Checking of the expansion valve and, if it is not in good condition, its replacement. In the case of a compressor whose cooling circuit uses a throttle valve, this must be replaced;
  • Use of the appropriate gas for which the compressor was designed;
  • Checking of the compressor's oil level after fitting.

Engines

The engine warranty refers exclusively to the main part of the engine, comprising the cylinder head, block, sump and respective internal working components. In the case of diesel engines, the warranty also includes the injection pump and the turbo, where it is a turbocharged engine.

Since it is not possible to know exactly what maintenance operations were carried out on the engine, nor whether they were carried out under the conditions laid down by the manufacturer, a timing kit must be fitted. A long time may also pass between the vehicle entering stock and the engine being installed in another vehicle, so it may be necessary to replace the water pump and the thermostat. It is equally important to replace gaskets, filters, oils, coolants and any wearing element of the engine. As the engine is a used and worn part, it may lose oil within the manufacturer's limits as a result of natural wear.

For the engine warranty to be valid, proof of the timing belt change is required. Excluded from the warranty are the external parts fitted to the engine, in particular the injector body, injectors, hoses, distributor, coils, water pump, clutch, intake and exhaust manifolds, radiators, vacuum pumps, fans, sensors and electrical wiring, or any other part not mentioned. Also excluded are the heating and overheating of the engine due to causes unrelated to it and the improper use of oils and other fluids.

Other Warranty Considerations

The products sold by Moticristo are duly identified with their own marks and engravings, for the correct identification of their origin in the event of a return. Such marks and engravings cannot be tampered with, on pain of loss of the warranty.

Moticristo accepts no responsibility for warranties or returns in cases where the parts require special installation or adaptation. Parts that require coding lose the warranty from the moment they are tampered with, and the customer should take this into account before making the purchase. In all cases, labour and the use of replacement vehicles are excluded from the warranty on the parts sold by Moticristo. The invoice constitutes the proof for any claim and must be kept by the customer in order to exercise their rights.

Car Hire (Rent-a-Car)

The car hire service is governed by specific conditions, in particular regarding rates, deposit, minimum age, included mileage, insurance and liabilities, which are provided to the customer at the time of booking and of entering into the respective hire contract.

Consumer Dispute Resolution

In the event of a consumer dispute, as defined under Law no. 144/2015, of 8 September, the consumer may refer the matter to the competent alternative consumer dispute resolution body: Arbitration Centre for the Automotive Sector (www.arbitragemauto.pt).

Without prejudice to the provisions of the legislation, statutes and regulations by which alternative consumer dispute resolution bodies are bound, the consumer may also opt for the European online dispute resolution platform, available at webgate.ec.europa.eu/odr, the alternative resolution body of their place of residence or a body with specialised competence. The updated list of alternative resolution bodies is available at www.consumidor.pt.

Applicable Law and Jurisdiction

These Terms and Conditions are subject to Portuguese law. For all matters arising from them, the parties elect the jurisdiction of the Lisbon District.
